RE: The tariff classification of men’s woven sleep shorts from China.

Dear Mr. Cattan:

In your letter dated April 24, 2008, you requested a tariff classification ruling. Your sample is being retained for our files.

Style EZ70286J, Model 1030, is a men’s jam length sleep short constructed from 100% cotton, yarn dyed, woven flannel fabric. Style EZ70286J has a covered elastic waistband with an outside drawstring; an open, unsecured fly with no means of closure; side seam pockets; and hemmed legs.

The applicable subheading for Style EZ70286J will be 6207.91.3010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for men’s or boys’ singlets and other undershirts, underpants, briefs, nightshirts, pajamas, bathrobes, dressing gowns and similar articles: other: of cotton: other sleepwear. The rate of duty rate is 6.1% ad valorem.

Style EZ70286J falls within textile category designation 351. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries.
